The Plaintiff or Defendant must reside in the North Carolina for six (6) months prior to filing for divorce. North Carolina requires that the parties live separate and apart for one year and one day prior to filing for a divorce. Once the parties live separate and apart for at least one year, either party can file for divorce. The complaining party must prove to the court that he has served the defendant with a complaint and civil summons. This is accomplished typically via certified mail. If the certified mail is unsuccessful, then it may be accomplished by sheriff and if the sheriff is not successful then service may be made by publication in a newspaper qualified for legal advertisements. How Long Does a Divorce Take? There is no set time for how long a divorce can take. The defendant has 30 days to respond. If 30 days have passed and there is proof that the defendant has been served, we can submit a motion for summary judgment for divorce. The court will establish a court date which is typically some weeks in the future from your filing your motion for summary judgment. As such a typical divorce can take about three to four months while international divorces can run from four to six months. The good news is when we file divorces in Mecklenburg County even if you live in another North Carolina county, neither party has to go to court. We handle all of that for you. What Are The Court Costs? The Mecklenburg County Court costs for a divorce are as follows: $225.00 for the divorce complaint, $20.00 for a notice of hearing and $10.00 if you wish to resume you maiden name. Service of Divorce complaint and civil summons via sheriff and/or process server can range from $10.00 to $500.00 dollars. In Mecklenburg County the sheriff’s Office currently charges $20.00 dollars, but that is subject to change. Any additional summons that may be required is $15.00 dollars.
